YEET Pick'Em - Terms of Use

1. Introduction

These Terms of Use ("Terms") govern participation in the Yeet Pick'Em promotion ("Game"), operated by YEET ("YEET", "we", "our", or "us").

By accessing, entering, or participating in the Game, you agree to be bound by:

The YEET Terms of Service; and

The YEET Privacy Policy.

If you do not agree to these Terms, you must not participate in the Game.

The Game is a free-to-play promotional competition. No purchase, payment, stake, wager, or consideration is required to participate.

YEET is solely responsible for the operation and administration of the Game.

This promotion is not sponsored, endorsed, administered by, or associated with FIFA or any other sports association.

YEET reserves the right to request proof of age, identity, residence, account ownership, or eligibility at any time.

3. Account Requirements

Participants must participate using their own YEET account.

Only one account may be used per individual unless expressly authorised by YEET.

Participants are responsible for maintaining the confidentiality and security of their account credentials and for all activity conducted through their account.

YEET reserves the right to suspend, restrict, or terminate accounts that breach these Terms, the General Rules, the YEET Terms of Service, or applicable law.

4. Game Participation

Each GameRound consists of questions relating to sport events and tournament outcomes, as described in the General Rules.

Participants select their predictions ("Picks") by choosing one answer for each question.

All questions must be answered before a participant can access the Game Confirmation screen.

A GameRound is considered submitted once the participant confirms their Picks on the Game Confirmation screen.

Participants may review and amend their Picks before the applicable GameRound closing time.

Once a GameRound has closed, Picks cannot be amended, withdrawn, or resubmitted.

The operation, scoring, settlement, prize allocation, and any voiding of GameRounds are governed by the General Rules.

5. Fair Play and Settlement

YEET reserves the right to investigate any participant, entry, account, or GameRound activity where fraud, collusion, abuse, manipulation, automated participation, or any other conduct that may compromise the integrity of the Game is suspected.

Where YEET reasonably suspects a breach of these Terms, the General Rules, or the YEET Terms of Service, YEET may suspend accounts, void entries, withhold prizes, disqualify participants, or take any other action it considers appropriate.

The settlement of GameRounds and questions is based on information obtained from official competition organisers, data providers, and other reputable sources selected by YEET.

While settlement sources may be identified in the General Rules or other game-specific documentation, YEET reserves the right to use any source that it reasonably considers reliable and appropriate for determining outcomes, settling questions, and administering the Game.

6. Verification and Prize Fulfilment

Prize eligibility, prize allocation, winner determination, and prize payment timelines are governed by the General Rules.

YEET reserves the right to verify the identity, age, residence, account ownership, and eligibility of any participant before any prize is awarded.

Failure to provide requested verification information within a reasonable timeframe may result in disqualification or forfeiture of prizes.

To facilitate prize verification and distribution, YEET may share a participant's unique YEET User ID with the promoter responsible for funding or administering prizes.

No personal information, including a participant's name, email address, telephone number, date of birth, or account information, will be shared with the promoter unless required by law.

By participating in the Game, participants consent to YEET sharing their YEET User ID solely for the purpose of administering, verifying, and distributing prizes in connection with the Game.

Personal information collected in connection with the Game will be processed in accordance with the YEET Privacy Policy.

All intellectual property rights relating to the Game, including software, branding, graphics, content, designs, trademarks, and materials, remain the property of YEET or its licensors.

Participation in the Game does not grant participants any ownership rights in any intellectual property associated with the Game.

YEET reserves the right to amend these Terms, modify the Game, suspend participation, cancel GameRounds, or terminate the Game where reasonably necessary for legal, regulatory, operational, integrity, security, or technical reasons.

YEET shall not be liable for any loss arising from such actions.

11. Limitation of Liability

To the fullest extent permitted by applicable law, YEET shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from participation in the Game.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded under applicable law.

12. Final Decisions

YEET's decisions regarding eligibility, verification, settlement, interpretation of the General Rules, application of these Terms, and administration of the Game shall be final and binding on all participants.

Entries that do not comply with the General Rules, these Terms, the YEET Terms of Service, or applicable law may be disqualified.

Except where required by applicable law, no correspondence or appeals will be entered into regarding YEET's decisions.

13. Relationship with the General Rules

The Yeet Pick'Em – General Rules form part of these Terms.

In the event of any inconsistency between these Terms and the General Rules, the General Rules shall prevail in relation to the operation, scoring, settlement, and prize allocation of the Game.

14. Relationship with the YEET Terms of Service

The YEET Terms of Service continue to apply to all users of the YEET platform.

In the event of any inconsistency between these Terms and the YEET Terms of Service, these Terms shall prevail solely in relation to participation in the Game.

15. Language

These Terms may be translated into multiple languages.

In the event of any inconsistency or discrepancy between a translated version and the English version, the English version shall prevail.

16. Governing Law

These Terms shall be governed by and construed in accordance with the governing law specified in the YEET Terms of Service.

Any dispute arising from or relating to the Game shall be subject to the dispute resolution and jurisdiction provisions contained in the YEET Terms of Service.
